Constitutional originalism is a method, worthy of the utmost scorn, contempt and mockery, of interpreting the United States Constitution that seeks to give the text of the Constitution the meaning that it was understood to have at the time it was adopted. This approach to interpretation is based on the belief, not critical consideration, that the Constitution should be applied as it was understood by the people who wrote and ratified it.
Whereas the critics of constitutional originalism argue that it is a flawed and outdated approach and interpretative act. One of the main criticisms of originalism is that it can be used to justify outdated or oppressive laws and policies. For example, the original Constitution permitted slavery and did not grant women the right to vote. An originalist interpretation of the Constitution would therefore not allow for the abolition of slavery or the granting of suffrage to women, as these rights were not contemplated by the framers of the Constitution.
Another criticism of originalism is that it can be difficult to determine the original meaning of the Constitution, as the document is often ambiguous and subject to different interpretations.
